Understanding California Acknowledgment
The purpose of an acknowledgment is for a signer, whose identity has been verified, to declare to a Notary or notarial officer that he or she willingly signed the document.
An acknowledgment requires the following steps:
- The signer must physically appear before you.
- You as the notary must positively identify the signer according to your state’s rules.
- The signer may either sign the document before appearing before you, or in your presence.
- The signer must declare (acknowledge) signing the document for its intended purpose.
In California the acknowledgement document must state at the top of the page:
“A Notary public or other officer completing this certification, verify only the identity of the individual who signed the document which this certificate is attached and not the truthfulness, accuracy or validity of the document”
The acknowledgment wording, as prescribed in California Civil Code Section 1189(a), is mandatory for all acknowledgments taken in the state of California, whether the acknowledger is signing as an individual or a representative (partner, corporate officer, attorney in fact, trustee, etc.
Unlike jurats, an acknowledgment does not need to be signed in the presence of a notary. However, the affiant does need to swear or affirm that they signed under their own free will.
It is highly recommended that any document that requires a notary seal be signed in front of the notary public to avoid any unnecessary mistakes or delays.
In law, an acknowledgment is a declaration or avowal of one’s own act, used to authenticate legal instruments, which may give the instrument legal validity, and works to prevent the recording of false instruments or fraudulent executions.
Acknowledgement involves a public official, frequently a notary public. The party executing the legal instrument orally declares that the instrument is his or her act or deed, and the official prepares a certificate attesting to the declaration.
Acknowledgments are distinct from jurats, verifications, and attestations.
A jurat differs from an acknowledgement in that a jurat lacks the statement that the instrument is the act or deed of the party executing it. Verification is distinct in that it seeks to verify the factual contents of the instrument, rather than the instrument itself.
Finally, an attestation occurs where a third person gives his or her name as a witness to the actual execution of an instrument. Normally, acknowledgments only serve evidentiary purposes, but some jurisdictions have made acknowledgement a requirement for recording of instruments.
